Trade compliance is becoming more complex as the economic sanctions regime continuously evolves. Emerging changes are drastically affecting various aspects of international trade such as imports, exports, foreign investments, and oil prices. Recently, Canada has introduced new legislation to include definitions of ownership and control and introduced new rules for seizing and forfeiting assets of Russian nationals, thereby pushing the boundaries of international sanctions law.

In addition, firms should be aware of the increasing frequency of US sanctions resulting from the Ukraine conflict and other global policy shifts and improve their understanding of sanctioned entities’ strategies to circumvent such sanctions. Furthermore, it is crucial for firms to acknowledge the significant emphasis placed by US Customs and Border Protection on enforcing sanctions against forced labor goods and tackling the evasion of trade measures.

William Pellerin

William Pellerin is a partner in the international trade group. He has extensive experience litigating and advising on matters and disputes before Canadian trade authorities as well as internationally, including with respect to the novel use of sanctions laws. He is one of the very few private practice lawyers in Canada to have argued before the WTO Appellate Body and dispute settlement panels.

William is the co-lead of McMillan’s Sanctions team. He advises numerous Fortune 500 companies on complex sanctions matters. He frequently advises multinational companies and funds on issues of ownership and control arising from commercial transactions and financial assets. William is at the leading edge of sanctions developments in Canada, acting with respect to the first (and to date, only) use of Canada’s new seizure and forfeiture regime.

He is a sought-after commentator and speaker on trade and sanctions matters, and as such is frequently interviewed and cited by Canada’s leading media outlets.
