Further to Jeffrey Levine’s article, “Social Security Numbers: Nine Non-Discoverable Digits,” (Aug. 9) regarding Social Security numbers, in Meyerson v. Prime Realty Services, LLC, 7 Misc. 3d 911, Justice Diane Lebedeff ruled that Social Security numbers are privileged and are not subject to disclosure. That decision contains an extensive discussion and citation of New York state decisions through 2005.

In Entral Group International, LLC v. YHCL Vision Corp., 436 F. Supp. 2d 404 (EDNY 2008), Eastern District Judge Edward Korman similarly ruled that Social Security numbers were privileged and generally not subject to disclosure. In Entral, it was suggested to the court by plaintiff, who was attempting to learn the Social Security numbers of non-party witness who had been subpoenaed, that the court issue an “eyes only” protective order to prevent dissemination of the Social Security numbers.
