U.S. District Judge Valerie Caproni of the Southern District of New York on Friday dismissed a lawsuit against the court-appointed guardian of artist Peter Max, who has Alzheimer’s disease, ruling that Max’s daughter’s claim of intentional infliction of emotional distress is barred under Rooker-Feldman doctrine.

Max’s daughter Libra Max sued her father’s guardian, Barbara Lissner, in federal court in June. Her lead counsel Jeffrey Eilender of Schlam Stone & Dolan argued that Lissner was isolating Peter Max and behaving in a financially predatory manner as he neared the end of his life.
