To aggressively enforce its antitrust agenda, the Biden Administration is taking bolder approaches by ramping up antitrust enforcement. In one of its recent moves, the Federal Trade Commission (FTC) and the U.S. Department of Justice (DOJ) Antitrust Division jointly announced their plans to modernize current merger guidelines.

The ongoing merger surge has bred mounting concerns relating to antitrust and other significant competition practices. Recent developments in this area of law also point to a stricter regulatory landscape and potential reforms. Thus, companies and all affected individuals must stay updated with the critical issues and considerations posed by this heightened scrutiny.

In this session, distinguished professionals in antitrust law and compliance Kail J. Mr. Ding focuses on merger filing, antitrust litigation, antitrust investigation, and antitrust compliance. He has accumulated a vast amount of experience in his more than ten years of practice. Mr. Ding was one of the first Chinese lawyers to appear in the WTO, and is one of the first lawyers in China to have been in contact with and long engaged in the 337 investigation practice.

Kail Jethmalani represents clients in all areas of antitrust law, including high-stakes litigation, M&A, investigations, and counseling. He has experience with both domestic and cross-border M&A transactions, representing clients before the U.S. Department of Justice, Federal Trade Commission, and competition regulators in Europe, China, Korea, Japan, India, and other jurisdictions. Kail represents clients in multi-district litigations around the country, as well as in sensitive government and internal investigations. Kail also counsels clients on antitrust issues relating to their core business practices. Additionally, Kail maintains an active pro bono practice. He recently led a team that secured asylum for a pro bono client fleeing political persecution. The New York State Bar Association has recognized Kail’s pro bono contributions through the Empire State Counsel program.
