There have been two important decisions concerning asbestos-related diseases in the last month. The first is the Court of Appeal decision in Maguire v Harland and Wolff. This case concerned the date of knowledge and therefore foreseeability for a claim for secondary exposure to asbestos.

Mr Maguire worked for Harland and Wolff and when he came home at night he was covered in asbestos dust. His wife was exposed to the dust on him and washed his overalls. She contracted, and died of, mesothelioma.
