Full marks for shadow home secretary David Davis for doing his bit to ensure that the law was not neglected during the summer silly season.

No doubt taking inspiration from the US presidential election, where a heated debate is taking place about the merits of trial lawyers, Davis announced an inquiry into the Human Rights Act, (HRA) claiming it had created too many “spurious rights”, thereby fuelling a compensation culture. One wonders what spurious rights he is referring to here – the right not to suffer inhuman or degrading treatment perhaps, or the right to a fair trial. Then again, Davis appears to have struck a chord with the business law community.
