The recent publication of the draft European Constitution attracted considerable media attention throughout Europe and beyond.

The proposals set out by Valery Giscard d’Estaing, the President of the Convention of the Future of Europe, include a provision to give the European Union’s (EU’s) Charter of Fundamental Rights legal force. The Convention is pushing for the adoption of the charter as a way to plug the perceived gap in protection between national and EU courts – a measure that some governments fear could precipitate a further transfer of sovereignty away from member states.
