If I were to ask you: “Which electronic evidence vendor do you use to retrieve and organise computer files turned over in discovery?” what would you say? In a recent survey of the top 200 US law firms, 75% of respondents cited a preferred vendor. I am not so sure we would find a similar level of response if those surveyed were UK-based law firms.
When it comes to electronic documents in disclosure, the UK is still behind the US, and while I accept that the legal sector always has been, and may always be, in love with paper, the world outside is not.
