Lawyers in England and Wales have long recognised that Scots law is just a ‘wee bit’ different to their own and have usually had the good sense to contact a lawyer friend north of the border when an issue crops up. The few who have overlooked taking this precaution have paid the penalty through professional indemnity claims.

One could certainly be forgiven for assuming that the establishment of the Scottish Parliament in the summer of 1999 might trigger even more diversity between the two legal systems.
