Australia is set to toughen up the regulation of lawyers in the wake of the British American Tobacco (BAT) shredding row, while the partner at the centre of the case has won leave to appeal against the ruling earlier this year that he helped deny a fair trial to a woman dying of cancer.

The new rules are being spearheaded by New South Wales Attorney General Robert Debus and are expected to specifically clamp down on the destruction of documents that may be of interest to a court, citing lawyers’ duty to the courts over that of their clients.
