The consultation document on the Government’s proposals for the overhaul of Tupe (the Transfer of Undertakings [Protection of Employment] Regulations 1981 as amended) is finally out. The reforms will implement the 1998 revised Acquired Rights Directive, which should have been implemented in the UK in July.

The proposed changes to Tupe go further than had been expected. This may be due to pressure from the unions because the Government is keen to secure their support to carry out reforms in the public sector, particularly to the National Health Service.
