Amendments to the Acquired Rights Directive
The Acquired Rights Directive in relation to transfer of undertakings has been amended. The directive contains a definition of a transfer, clarifying the law created by a stream of decisions of the European Court of Justice.
The directive gives national governments the opportunity to make significant changes to their legislation on transfer of undertakings. It remains to be seen how the UK Government will approach the legislation, but the powers contained in the directive are as follows:
