A senior figure at Dechert has admitted his firm failed to disclose potentially revelatory text messages involving former white collar head Neil Gerrard, in the latest twist to the ENRC v Dechert case.

ENRC’s lawyers argue that text message exchanges between Gerrard and Serious Fraud Office employees, sent between 2012 and 2013, help prove collusion between Gerrard and prosecutors at the SFO. But ENRC has accused Dechert of failing to properly disclose the messages, despite “knowing that back-ups existed as far back as 2015″, a person close to the matter said.
