Osborne Clarke and EIP Legal have led global patent companies Unwired Planet and Conversant Wireless to victory in the U.K. Supreme Court, which dismissed appeals by telecoms giants Huawei and ZTE, handing Allen & Overy a notable defeat.
The ruling in the two linked appeals, Unwired Planet v Huawei and Conversant Wireless v Huawei & ZTE, underscores that English courts have the power to determine the terms of a global license of a multi-national patent portfolio, and further, that they have the power to rule on actions concerning the infringement of patents that are essential to the implementation of international standards for mobile telephony.
