The Enterprise Bill may be in force as soon as late November. Its criminal provisions appear to represent part of a high priority political drive to increase the extent to which senior management can be held criminally liable for their actions.

For the first time, those who engage in anti-competitive cartel arrangements will be brought within reach of the criminal justice system and specific activities that will be criminalised include price fixing, market sharing, bid rigging and imposing output restrictions or selling quotas.
