In last month’s column, I focused on the good news that the Philadelphia-based U.S. Court of Appeals for the Third Circuit received from the U.S. Supreme Court during the high court’s just-concluded 2020-2021 term. Overall, the Third Circuit achieved an impressive 60% approval rating.

But in cases that the Supreme Court decided on direct review from the Third Circuit, our local federal appellate court’s approval rating was just 33%—because the Supreme Court affirmed the Third Circuit in only two of the six cases on direct review. This month’s column focuses on the details of the four cases in which the Supreme Court did not agree with the Third Circuit last term.
