A Lancaster County judge has denied an insurance company’s request for a declaration that its household exclusion policy means it does not have to pay UIM benefits to the family of a man injured in a motorcycle accident.

Lancaster County Court of Common Pleas President Judge David Ashworth’s ruling in Donegal Mutual Insurance Co.’s case against the Krautsack family comes after the state Supreme Court’s landmark ruling in Gallagher v. Geico.
