The family of a man who was run over by a New York City subway train in Queens is suing the Metropolitan Transportation Authority for his death, alleging that the motorman on a southbound “7″ train failed to pump the brakes while the decedent was standing on the tracks.

According to the complaint, at about 12:30 p.m. on March 31, 2022, Eduardo Barrera Marin allegedly fell on the tracks at the 40th Street-Lowery Street Station in Sunnyside, Queens by no fault of his own.
