Labaton Sucharow partner Carol Villegas along with Christian Levis from Lowey Dannenberg and Diana Zinser from Spector Rosemen & Kodroff have been litigating against the app-maker Flo Health since January of last year. The case focuses on the use or alleged misuse of personal information about a woman’s reproductive cycle and the sharing of that information with other parties, including advertisers. In light of the ongoing abortion debate, the personal data stored using this and similar health apps could soon have a new and different relevance—and could potentially even lead to criminal prosecution. A conversation with Carol Villegas.

How long have you been litigating the Flo Health app case, and what’s at stake in relation to data privacy?
