Following opposition from a civil rights group and others, a rules committee has nixed a Justice Department proposal to extend the deadline that federal officials have to reply to lawsuits filed against them related to their duties, in which “qualified immunity” is often raised as a defense.

The Advisory Committee on Civil Rules on Tuesday removed from its agenda a rule amendment the department suggested in 2020 under the Trump administration, which would have given officials sued in their individual capacities 60 days to answer complaints that aren’t initially dismissed by a judge, instead of the current 14 days for all defendants.
