Governor Andrew M. Cuomo scored another win in the budget battle last week by pushing through his plan to reduce by 30 percent the capacity of state facilities for troubled youths. He also was able to decrease the warning period to close a youth facility or state prison to 60 days from 12 months, although he had hoped to eliminate the warning period completely.

The plan also requires the Office of Children and Family Services to consider a series of factors when closing or significantly downsizing a facility, including whether the state can provide a “safe, humane and therapeutic environment” for relocated youths and that the educational, mental health and substance abuse treatment needs of youths can be met (A04000/S2800).
