A federal judge last week struck down a New York state law barring immigrants, other than green card holders, from being licensed as pharmacists, saying that his ruling was not even a close call under the U.S. Constitution’s Equal Protection Clause.
Southern District Judge Richard J. Holwell’s analysis concluded that Education Law §6805(1)(6) is subject to “heightened scrutiny” under equal protection jurisprudence.
