Noting that "not every wrong can be addressed through the judicial process," Southern District Judge Alvin Hellerstein yesterday dismissed the emotional case over how to handle soil at the closed Fresh Kills landfill that may contain the remains of 9/11 victims. Judge Hellerstein had tried to forge a compromise been New York City and families of the deceased who wanted hundreds of thousands of pounds of World Trade Center debris removed from the Staten Island landfill. But with no agreement in sight, the judge held that the families had not stated a legal claim.
