ALBANY - A plaintiff seeking recovery on an unjust enrichment claim must establish not only a nexus with the defendant, but that the plaintiff and defendant had dealings together, a divided Court of Appeals held yesterday.

While the majority in Georgia Malone & Co. v. Rieder, 132, suggested the court is only following precedent, two dissenting judges said the ruling represents a substantial expansion of prior holdings.
