The Georgia Supreme Court on Monday reinstated a $35 million verdict for the family of a man severely brain damaged by a gang attack outside Six Flags Over Georgia—but left open the question of how much the amusement park will have to pay.
The justices ordered the case back to Cobb County State Court for a determination on apportionment of fault. The jury placed 92 percent of the blame on Six Flags and 2 percent on each of four attackers. Six Flags argued successfully on appeal that more attackers should be added—giving the theme park a shot at reducing its judgment lower than the original $32 million tab.
