The Florida Supreme Court affirmed a First District Court of Appeal ruling that vacated a $28.6 million verdict centered on the apportionment of liability following an incident in which a driver struck a pedestrian.

And in doing so—in a case that pits the respondent, Potbelly’s, against the petitioner, the Guardianship of Jaquelyn Faircloth, an 18-year-old who was struck by a car driven by an employee of the well known Tallahassee bar—the state Supreme Court was faced with the following certified “question of great public importance”:
