As the digital marketplace grows with consumers and businesses trying to keep pace, we see it everywhere: “click here to accept terms and conditions” or “by continuing to use this page, you agree to our terms of use.”  These and other online statements of “assent” to privacy policies, terms of service, or other disclosures are known as “click-through” agreements, further broken down into classes of “clickwrap”, “browsewrap” agreements (or “hybrids”).

For business, clickthroughs enable paperless business with an expansive base.  For consumers (“Users”), they enable a fast path to goods and services.  For both, they’re simple.  Or at least they should be.
