A federal judge in Massachusetts denied a marijuana dispensary’s motion for leave to file additional allegations against HSBC Bank, finding the plaintiff failed to show the financial institution had actual knowledge of fraudulent conduct relating to the transfer of more than $459,000 in a hacking scheme.

Alexander Mazin, the president and CEO of Bud’s Goods & Provisions Corp., contracted with Mike Holland, of M. Holland and Sons Construction, to build a storefront for the marijuana dispensary. Once the project was complete in 2020, Holland emailed Bud’s an invoice. Unknowingly, Bud’s email account was being monitored by an anonymous hacker, according to the court’s order filed June 21.
