Plaintiff Forest Hills Garden Corporation, a homeowners association representing about 900 property owners in the neighborhood suing defendant The West Side Tennis Club regarding noise emanating from concerts held at Forest Hills Stadium, moved for an order to show cause for injunctive relief prohibiting defendants from permitting excessive noise from the stadium.
Queens Supreme Court Joseph Esposito granted the motion, finding plaintiff demonstrated a likelihood of success on the merits and established the prospect of irreparable harm if relief is not granted.
