In an apparent unprecedented move, the Third Circuit has permitted a Pennsylvania district court’s appointment of a special master to conduct an independent review of an insurance company’s claim denial.

Judge Cheryl Ann Krause of the U.S. Court of Appeals for the Third Circuit authored the Oct. 26 order, where the court greenlit a special master wading into an Employee Retirement Income Security Act (ERISA) case.
