Uber Technologies cannot force arbitration of a discrimination lawsuit filed by motorized wheelchair users, the U.S. Court of Appeals for the Third Circuit ruled Wednesday.

The plaintiffs are motorized-wheelchair users who live in the Pittsburgh area and the nonprofit Pittsburghers for Public Transit, whose mission is to make “transportation … available and accessible to all, including people with limited mobility,” as Judge Cheryl Ann Krause put it, writing for a panel that included Judge Peter Phipps of the Third Circuit and U.S. District Judge Wendy Beetlestone of the Eastern District of Pennsylvania, sitting by designation.
