According to Judge Jennifer Walker Elrod, there are certain things that residents in the U.S. Court of Appeals for the Fifth Circuit's home base of New Orleans come to expect during the summer — the temperature rises, the days get longer and the lines grow outside the city's most popular sno-ball shops. And each new year also brings another round of litigation between the Big Easy's preeminent sno-ball makers Southern Snow and SnoWizard. So the Fifth Circuit judge finally had enough and put a stop to seemingly endless patent and trademark litigation between the sellers of the flavored ice confections in a recent pun-laden opinion she wrote entitled Snow Ingredients v. SnoWizard.
