A class action law firm involved in a gender discrimination suit against Merck has agreed not to issue any further communications to potential opt-in plaintiffs, after the drugmaker sought a cease and desist order over what it claimed were misleading statements the firm made aimed at increasing the number of plaintiffs.

U.S. District Judge Michael A. Shipp for the District of New Jersey issued an order Friday in Smith v. Merck & Co. denying Merck’s request for a cease and desist order, finding that the issue had become moot since the plaintiffs’ counsel said it does not intend on sending any further communications during the opt-in period. Claimants have until Aug. 12 to join the case.
