In the appeal of an interlocutory order, the Appellate Division affirmed a trial court order which compelled defendants Gerber and Nestlé to produce a Swiss-based employee for an in-person deposition in New Jersey at their own expense, despite the defendants’ arguments that the trial court erred.

In the underlying employment discrimination case, plaintiff Denise Willson sued Gerber Products, Nestlé Healthcare Nutrition, Nestlé Holdings, and William Partyka, the president and CEO of Gerber. Willson’s complaint alleged that she met with Partyka’s supervisor, Alexandre Costa, and informed him of her retaliatory termination, sex discrimination and failure-to- promote lawsuit against the defendants, according to an opinion filed Tuesday.
