Cohen & Gresser partner Mark S. Cohen aimed to present FTX founder Sam Bankman-Fried as a well-meaning and innovative entrepreneur in his opening statement Wednesday, as he urged the jury in the Southern District of New York to find his client not guilty of fraud offenses.

Cohen said prosecutors are presenting a “hindsight case,” asking jurors to judge Bankman-Fried based on information that wasn’t available during his company’s collapse in November.
