On Sept. 20, 2023, the New York State Governor signed Chapter 476 of the 2023 New York State Laws. This Chapter amends Election Law Section 12-106 to add a new paragraph that requires each elector to cast her or his ballot for president and vice president for the candidates nominated by the political party that nominated the elector.

Previously, New York did not bind its electors, although there was an old, obscure, lower court case that suggested that electors should vote for the presidential candidate of the political party that nominated them. New York follows a trend, recently also followed in Delaware, towards eliminating the possibility of so-called faithless electors. More than 30 states are now binding states.
