A New York appeals court declined to dismiss the University of Rochester from a Child Victims Act lawsuit that alleges school officials did nothing after a then 17-year-old student reported she had been raped by two male students who were members of a campus fraternity in 1984.

The Appellate Division, Third Department’s 5-0 decision on Thursday in Rebekah Brown v. University of Rochester affirmed a December 2021 trial court ruling by state Supreme Court Justice L. Michael Mackey.
