Addressing a novel issue in the Appellate Division, First Department, a panel of justices on Thursday ruled that the common-law “danger invites rescue doctrine” does apply to personal-injury lawsuits brought under a state Labor Law section that ties itself to Industrial Code safety provisions at construction sites.

Before Thursday’s decision, the First Department appeals court had not addressed whether the century-and-a-half-old doctrine, which has long applied in personal injury situations, can be used when a claim is brought under state Labor Law § 241(6).
