The Commercial Division Advisory Council is seeking public comment on a proposed rules amendment and proposed updates to a stipulation and order form.

The first proposal would amend Section 202.70(d) to add a sample “choice of law” provision for use by parties in commercial contracts. The Advisory Council said the change would reduce litigation over choice-of-law issues and help litigants who would prefer state law to govern their disputes. The Advisory Council also said it would help in “showcasing New York’s comprehensive body of predictable and sensible commercial law.”
