The Biden administration’s Justice Department on Monday asked the U.S. Supreme Court to block enforcement of Texas’ six-week abortion ban and to decide whether the law is constitutional after briefing and argument in the current term.

“The question now is whether Texas’s nullification of this court’s precedents should be allowed to continue while the courts consider the United States’ suit. As the district court recognized, it should not,” acting U.S. Solicitor General Brian Fletcher wrote in the government’s request that the court lift the stay of a district court’s preliminary injunction against the law.
