Passenger claiming neck injury gets $91,500

On June 7, a jury awarded $91,500 to a woman who claimed that she sustained a cervical herniation in a three-car crash. In 2009, Vanessa Kotrulja was involved in a collision with a car driven by Gary McCuistion. Her car was subsequently involved in a collision with a third car. Kotrulja claimed a 2-mm focal herniation at C3-4. She claimed that she will require pain treatment for the rest of her life. Defense counsel argued that Kotrulja’s injuries were a pre-existing condition and that her claimed medical expenses were unecessary and excessive.
