Texas A&M University supporters have sued the Texas A&M University 12th Man Foundation, alleging it breached a contract by failing to provide them with “best available premium” parking for football games in return for their $20,000 scholarship donation.

Tom G. and Delma C. Tullos allege in their Nov. 21 first amended petition that the foundation has failed to honor terms of the “Texas A&M University 12th Man Foundation Permanently Endowed Scholarship Agreement” they entered into in 1994 when donating the $20,000. The Tulloses allege they were promised the opportunity to buy season tickets to A&M home and away football games for 30 years in the “endowed seating area” and parking privileges in the “endowed parking area.” “This was represented by defendant to consist of the best available premium parking at Kyle Field,” the plaintiffs allege in Tullos, et al. v. Texas A&M University 12th Man Foundation.
