Driver awarded $127,950 for claimed back injury

On Feb. 16, a jury awarded $127,950 to a man who claimed that he sustained lumbar herniations in a collision with a truck. In 2007, Herodes Tovar was driving south on Bedell Street in Del Rio. At the intersection with Gibbs Street, he was involved in a collision with a truck driven by Jose Suarez, owner of Suarez Grocery and Tortilla Factory. Tovar claimed herniations at L4-5 and L5-S1. The plaintiff’s medical expert testified that he will require a laminectomy and diskectomy. Due to his injuries he was forced to take a new job that paid less than half what he was earning at the time of the collision, he claimed.
