On Sept. 10, a jury declined to award damages to a man who claimed a police officer used excessive force when his K-9 dog bit the plaintiff during an arrest. In 2007, police caught Robert Ballard in an office building in the early morning hours. He was arrested for burglary. Officer David Neck’s K-9 bit him during the arrest. Ballard claimed that Neck ordered the dog to attack him after he was handcuffed. Neck claimed that Ballard was on the floor and disobeyed a command to show one of his hands. Neck then released his hold on the dog’s collar and it bit his left calf once. The jury found Neck did not use excessive force.
