The state Superior Court has rejected a general contractor’s bid to gain immunity from civil liability in a case where a laborer was injured on the job, ruling that there were outstanding questions as to who the man was working for when he was injured.

Gary Shamis filed a civil complaint against Geppert Brothers Inc. claiming negligence against the company in relation to his injuries as a result of being run over by a dump truck while he was “on loan” to a subcontractor. Geppert asserted it was Shamis’ employer when the accident occurred and that Shamis is only entitled to reimbursement under the Workers’ Compensation Act.
