Blank Rome and another law firm got some breathing room last week from the U.S. Court of Appeals for the Third Circuit in a sealed case that had the firms caught between a defunct corporation and the government, which is seeking hundreds of allegedly privileged documents that are being held by Blank Rome. The government is seeking the documents as part of a grand jury investigation involving clients of the two firms.
The company, identified in the opinion as ABC Corp., and its father and son executives identified as John Doe 1 and John Doe 2, respectively tried to appeal a district court order that had granted the government’s request for the disclosure of the documents. According to the opinion, the government is “investigating the tax implications of ABC Corp.’s acquisition and sale of certain closely held companies.”
