Circuit Certifies Issue Of Attorney Deceit

The Second Circuit, in an opinion by Judge Robert Sack, yesterday certified two questions to the New York Court of Appeals regarding Judiciary Law §487, which penalizes attorneys who deceive state courts. The case involves attorney Armand Rosenberg, who argued that the law does not allow for liability on an unsuccessful attempt at deceit.
