Petitioner Joseph Kamenshchik, appearing pro se,  sought a judgment directing respondents to allow him to submit a pistol permit application by providing the information required pursuant to Penal Law §400.00, and without the other requirements imposed by respondent Patrick Ryder, in his official capacity as Commissioner of the Nassau County Police Department and as Licensing Officer for Nassau County.

Kamenshchik contended that Nassau County did not have the authority to add extra, local requirements, specifically challenging its fingerprinting requirements and wait time, as well as its requirements for personal references that exceeded those required by Penal Law §400.00(1).
