The California State Assembly is considering a bill that would amend the Safe Drinking Water and Toxic Enforcement Act of 1986, known as Proposition 65. The bill (AB 3004) would prohibit persons filing a private action under Proposition 65 from relying on outdated laboratory reports and would increase transparency in communications with the California attorney general.

Most attempts to amend Proposition 65 have failed, but this bill has a shot. Proposition 65 Proposition 65 requires businesses with 10 or more employees to provide a “clear and reasonable” warning before they cause an exposure to any of the 900-plus chemicals listed as known to the state to cause cancer or reproductive toxicity.
