The Second Appellate District affirmed orders. The court held that a deposit made by purchasers of real property from the estate of a conservatee was properly retained by the conservator after the purchasers failed to comply with the terms of escrow.

The Public Guardian of Los Angeles County was the conservator of the estate of Mary Buchenau. The guardian conducted a public auction of Buchenau’s former residence on Shoshone Avenue. Mario Tornel and Martha Silva’s bid was accepted by the guardian and the probate court confirmed sale of the Shoshone property to Tornel and Silva. Escrow was opened, pursuant to the instructions for which Tornel and Silva were to deposit ten percent of the purchase price and pay the balance two days before the close of escrow.
